Welcome to Zappyfi.

These Terms of Use ("Terms") govern your access to and use of the Zappyfi website, mobile applications, SmartSIM products, eSIM products, physical SIM cards, routers, accessories, customer portal, and any related services (collectively referred to as the "Services").

By accessing our website, downloading our mobile application, creating an account, purchasing products, or using any Zappyfi Service, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use our Services.

3. Eligibility

To purchase products or use our Services, you must be:

Services may vary by country, plan, device compatibility, and network availability.

5. Customer Accounts

You may create a Zappyfi account through:

  • Website registration
  • Mobile application registration
  • Apple Sign-In
  • Google Sign-In
  • Email verification services

You are responsible for:

  • Maintaining account security
  • Keeping login details confidential
  • All activity performed under your account

We may suspend or terminate accounts where fraud, abuse, misuse, or security concerns are identified.

6. SmartSIMs, eSIMs and Data Plans

All Zappyfi connectivity products are prepaid unless otherwise stated.

Data plans:

  • Activate upon first use or as specified
  • Expire after the advertised validity period
  • May expire regardless of whether all data has been consumed
  • Are non-transferable unless approved by Zappyfi

Customers are responsible for ensuring:

  • Device compatibility
  • Correct installation
  • Correct APN settings where applicable

7. Device Compatibility

Zappyfi cannot guarantee compatibility with every device.

Customers should verify that their device:

  • Supports unlocked SIM cards
  • Supports the required network technologies
  • Supports eSIM where applicable
  • Is correctly configured

Zappyfi shall not be liable for incompatibility caused by device manufacturers, software restrictions, firmware limitations, or third-party hardware.

8. Network Availability and Connectivity

Zappyfi SmartSIMs use advanced multi-network and roaming technologies to connect to available mobile networks.

Coverage, speeds, and service quality depend on:

  • Mobile network operators
  • Roaming partners
  • IMSI providers
  • Device capabilities
  • Local infrastructure
  • Geographic location
  • Environmental conditions

While Zappyfi uses commercially reasonable efforts to provide reliable connectivity, we do not guarantee:

  • Continuous service
  • Uninterrupted coverage
  • Specific network availability
  • Minimum data speeds
  • Latency performance
  • 100% uptime

Temporary interruptions may occur due to:

  • Carrier outages
  • Roaming partner failures
  • IMSI provider outages
  • Maintenance activities
  • Infrastructure failures
  • Regulatory restrictions
  • Third-party service disruptions

Customers using our Services in critical environments must maintain appropriate backup connectivity arrangements.

9. Service Interruptions and Maintenance

We may perform planned or emergency maintenance from time to time.

Services may be temporarily unavailable during:

  • Platform upgrades
  • Security updates
  • Infrastructure maintenance
  • Carrier maintenance windows
  • Third-party provider maintenance

We will use reasonable efforts to minimise disruption.

10. Lost, Stolen and Faulty SIMs

Customers should notify us promptly if a SIM is:

  • Lost
  • Stolen
  • Damaged
  • Faulty

Where appropriate:

  • Replacement SIMs may be provided
  • Delivery charges may apply
  • Remaining plan balances may be transferred where technically possible

Transfer of active plans cannot be guaranteed.

11. Routers and Hardware Warranty

Zappyfi routers include a 12-month limited warranty covering manufacturing defects under normal use.

The warranty excludes:

  • Accidental damage
  • Liquid damage
  • Misuse
  • Unauthorised modifications
  • Cosmetic wear
  • Damage caused by third-party accessories

Warranty remedies may include:

  • Repair
  • Replacement
  • Refund at our discretion

12. Orders, Pricing and Payments

Prices displayed on our website are inclusive of applicable taxes unless otherwise stated.

We reserve the right to:

  • Change prices
  • Withdraw products
  • Modify promotions
  • Correct pricing errors

Payments are processed by secure third-party payment providers.

Card details are not stored by Zappyfi.

13. Delivery

Delivery times are estimates only.

We are not liable for delays caused by:

  • Couriers
  • Customs authorities
  • Import controls
  • Weather events
  • Third-party delivery providers

Customers are responsible for applicable import duties and taxes.

14. Returns and Refunds

Physical products may be returned in accordance with applicable UK consumer laws.

Prepaid data plans are generally non-refundable once:

  • Activated
  • Installed
  • Used
  • Delivered electronically

Refund requests are assessed on a case-by-case basis.

15. Fair Usage Policy

Customers must not use Services:

  • For unlawful activities
  • For spam distribution
  • For network abuse
  • For fraudulent purposes
  • To interfere with telecommunications infrastructure
  • To reverse engineer Services
  • To circumvent technical controls

We reserve the right to suspend or terminate Services where misuse is identified.

16. Mobile Applications

Zappyfi mobile applications are provided on an "as available" basis.

We do not guarantee:

  • Continuous availability
  • Compatibility with all devices
  • Permanent availability of all features

Features may be modified, updated, or removed at any time.

17. Intellectual Property

All content, software, trademarks, branding, graphics, and materials remain the property of Zappyfi or its licensors.

You may not:

  • Copy
  • Modify
  • Distribute
  • Reproduce
  • Reverse engineer

without our written permission.

18. Third-Party Services

Certain services depend on third-party providers including:

  • Mobile network operators
  • Roaming partners
  • IMSI providers
  • Payment processors
  • Cloud providers
  • Delivery partners

Zappyfi is not responsible for interruptions, failures, restrictions, or service limitations caused by third-party providers.

19. Business and Commercial Use

Unless expressly agreed in writing through a separate Service Level Agreement (SLA), all Zappyfi Services are provided on a best-efforts basis.

No uptime guarantee, availability commitment, minimum throughput, latency guarantee, or performance warranty applies unless specifically agreed in writing.

Customers deploying Services in:

  • Tracking solutions
  • Fleet management
  • IoT deployments
  • Security systems
  • Monitoring systems
  • Healthcare applications
  • Business-critical environments

remain responsible for implementing appropriate backup and redundancy arrangements.

20. Limitation of Liability

To the maximum extent permitted by law, Zappyfi shall not be liable for:

  • Loss of profits
  • Loss of revenue
  • Loss of contracts
  • Loss of business opportunities
  • Loss of goodwill
  • Business interruption
  • Loss of anticipated savings
  • Loss of data
  • Installation costs
  • Engineering costs
  • Device replacement costs
  • Third-party claims
  • Customer compensation claims
  • Consequential losses
  • Indirect losses
  • Special damages

Our total aggregate liability shall not exceed the amount paid by the customer for the affected product or service during the twelve months preceding the event giving rise to the claim.

Nothing in these Terms excludes liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Any liability which cannot lawfully be excluded

21. Force Majeure

Zappyfi shall not be liable for delays, interruptions, or failures resulting from events beyond our reasonable control including:

  • Carrier outages
  • Network failures
  • Roaming partner failures
  • IMSI provider outages
  • Internet failures
  • Cyber attacks
  • Government restrictions
  • Regulatory changes
  • Natural disasters
  • Labour disputes
  • Power outages
  • Supplier failures

Affected obligations shall be suspended for the duration of such events.

22. Suspension and Termination

We may suspend or terminate Services where:

  • These Terms are breached
  • Fraud is suspected
  • Security concerns arise
  • Required by law
  • Payment disputes occur

Where reasonably possible, notice will be provided.

23. Privacy and Data Protection

Your use of Zappyfi Services is subject to our Privacy Policy and Cookie Policy.

We process personal data in accordance with:

  • UK GDPR
  • Data Protection Act 2018
  • Applicable UK privacy legislation

24. Changes to These Terms

We may update these Terms from time to time.

Updated versions will be published on our website.

Continued use of the Services constitutes acceptance of the revised Terms.

25. Governing Law

These Terms are governed by the laws of England and Wales.

Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
